Il danno da perdita del rapporto parentale è considerato risarcibile a prescindere da eventuali danni patrimoniali, poiché si tratta di un pregiudizio di tipo non patrimoniale che incide su diritti inviolabili della persona, come il diritto alla famiglia e alle relazioni affettive. La valutazione del risarcimento è soggetta a una quantificazione caso per caso, tenendo conto di vari fattori come la vicinanza affettiva, la durata del legame e l'effettiva sofferenza subita dai congiunti.
Nell’articolo pubblicato al seguente link https://shorturl.at/9gXuN è già stata trattata la tematica della risarcibilità del danno non patrimoniale patito dai congiunti del paziente deceduto a causa di un errore medico c.d. danno da perdita del rapporto parentale.
In tale sede, si è compreso che i congiunti, o comunque che i soggetti legati al de cuius da uno stretto legame affettivo e materiale possono richiedere il risarcimento del danno patito da loro stessi per aver perduto il proprio caro, sia per la sofferenza provata per la perdita, sia per il mutamento che tale assenza comporta a livello di abitudini quotidiane e relazionali. Come abbiamo visto, tale azione è esperibile iure proprio, a prescindere dalla qualità di eredi.
Resta ora da comprendere se, oltre al danno patito dalle c.d. vittime secondarie, sia risarcibile anche il danno patito direttamente dalla vita primaria, ossia il paziente, per la perdita della propria vita.
In questo ultimo caso, gli unici legittimati ad agire per conto del defunto saranno gli eredi, iure hereditario. La qualità di erede costituisce una vera e propria condizione dell’azione.
Negli anni, in tema di risarcibilità del danno da perdita della vita, c.d. danno tanatologico stricto sensu, la giurisprudenza è risultata sempre pressoché allineata.
Sin dal 1925, con la sentenza n. 3475 delle Sezioni Unite della Cassazione, infatti, i giudici sono stati concordi nel negare la risarcibilità di tale danno. Secondo la giurisprudenza, se i danni devono essere rapportati alla lesione, «questi entrano e possono logicamente entrare nel patrimonio del lesionato solo in quanto e fin quando il medesimo sia in vita. Questo spentosi, cessa anche la capacità di acquistare, che presuppone appunto e necessariamente l’esistenza di un subbietto di diritto».
Più di recente, nel 2006 e nel 2014, sono tuttavia intervenute due diverse pronunce della Cassazione a sezioni semplici, rispettivamente Cass. civ., sent. n. 15760/2006 e Cass. civ., sent. n. 1361/2014, che in qualche modo hanno messo in discussione questo orientamento ormai granito.
Entrambe, sulla base di argomentazioni differenti, hanno infatti riconosciuto la risarcibilità del danno da morte:
• la prima che, richiamando i principi della Costituzione europea che integrerebbero e completerebbero la fonte italiana sul diritto alla vita, ha ritenuto che il danno da morte fosse trasferibile mortis causa, poiché entrato a far parte del credito del defunto verso il danneggiante ed i suoi solidali, non potendosi parlare di morte immediata, se non in due casi: decapitazione e spappolamento del cervello.
• la seconda che ha invece posto il problema della risarcibilità del bene vita su un piano più etico, ritenendo, in particolare, che negare alla vittima il ristoro per la perdita della propria vita rimorderebbe alla «coscienza sociale», in quanto il bene della vita è bene supremo dell’individuo, oggetto di un diritto assoluto ed inviolabile garantito dall’ordinamento, in via primaria.
In quest’ottica, la perdita della vita andrà valutata ex ante e non già ex post rispetto all’evento che la determina: il «diritto al ristoro del danno da perdita della vita si acquisisce dalla vittima istantaneamente al momento della lesione mortale, e quindi anteriormente all’exitus»; a tal fine, la Corte richiama anche le norme internazionali ed europee che vanno ormai nella direzione di risarcire il danno da perdita della vita, senza alcuna distinzione tra morte immediata e morte dopo un apprezzabile lasso di tempo.
Questo apparente discostamento dall’orientamento maggioritario ha quindi reso necessario, nel 2015, un intervento delle Sezioni Unite, che sembrerebbero aver definitivamente chiuso ogni contrasto. Con la sentenza n. 15350/2015, le Sezioni Unite hanno infatti deciso di dare continuità al risalente e costante orientamento che negava il risarcimento del danno tanatologico, non essendo state dedotte ragioni convincenti che ne potessero giustificare il superamento.
Tutto ciò non esclude però che, sempre a livello di azione iure hereditario, possano comunque essere richiesti e risarciti anche altri danni non patrimoniali in favore del soggetto defunto, nei casi in cui tra l’evento lesivo e il decesso sia un intercorso un lasso di tempo minimo, sufficiente a far entrare nel patrimonio della vittima primaria un pregiudizio concreto.
Ci si riferisce, nella specie, al danno c.d. terminale, al danno catastrofale o da lucida agonia e al danno intermittente o da premorienza.
In breve:

il danno terminale, che corrisponde al danno biologico patito dalla vittima primaria che sia sopravvissuta all’illecito, per un apprezzabile lasso di tempo e che si liquiderà in termini di invalidità assoluta temporanea, attuando una personalizzazione in considerazione dell’entità ed intensità del danno.

Il danno catastrofale o da lucida agonia, che corrisponde al pregiudizio morale patito dalla vittima che sopravvive all’evento per un lasso di tempo assai contenuto, ma sufficiente a farle percepire l’avvicinamento dell’exitus. In questo caso, non rileverà la durata del periodo di sopravvivenza della vittima, ma piuttosto lo stato di coscienza della stessa. Qualora infatti la vittima dovesse versare in stato di incoscienza (es. coma), non si configurerà alcun danno risarcibile.

il danno biologico c.d. intermittente o da premorienza, che consiste nel pregiudizio all’integrità psico-fisica patito dalla vittima primaria, in conseguenza del fatto illecito di un terzo, nell’intervallo di tempo che intercorre tra la lesione e la morte del danneggiato, qualora la morte sia intervenuta per causa diversa dal fatto illecito del terzo.
Come vediamo dunque anche se il danno tanatologico in senso stretto non è risarcibile, gli eredi possono comunque agire (anche) per la tutela della vittima primaria deceduta per un errore dei sanitari che lo ebbero in cura.

The flames engulf Mohammed's form. He screams, but the sound is not his own. It's a chorus of a thousand voices, all screaming in unison.
